IMPORTANT – PLEASE READ CAREFULLY
By checking the boxes below and signing electronically, you agree to the terms of this legally binding Agreement.
1. ASSUMPTION OF RISK
☐ I understand that participation in fitness activities at Apex Fitness Center—including strength training, cardio, functional training (Hyrox, Deka, etc.), and group classes—carries inherent risks.
☐ I acknowledge these risks include, but are not limited to:
- Muscle strains, sprains, or tears
- Falls or equipment-related injuries
- Heart attack, stroke, or other serious medical events
- Severe injury or death
☐ I voluntarily assume full responsibility for all risks, known and unknown.
2. MEDICAL RESPONSIBILITY
☐ I confirm that I am physically able to participate.
☐ I understand it is my responsibility to consult a physician prior to participation if needed.
☐ I agree to stop any activity immediately if I feel pain, dizziness, or discomfort.
3. RELEASE OF LIABILITY
☐ I release and discharge Apex Fitness Center, its owners, staff, coaches, and affiliates from any and all liability for injuries, damages, or losses arising from my participation.
☐ This includes claims resulting from negligence to the fullest extent permitted by Texas law.
4. INDEMNIFICATION
☐ I agree to indemnify and hold harmless Apex Fitness Center from any claims, damages, or legal costs arising from my participation or actions.
5. FACILITY RULES & SAFETY
☐ I agree to follow all instructions, rules, and safety guidelines provided by staff.
☐ I understand that failure to comply may result in removal from the facility without refund.
6. CHILDREN POLICY (MANDATORY SAFETY RULE)
☐ I understand and agree that:
- Children are strictly NOT allowed in the training area during classes or any physical activity.
- Children must remain outside training zones and under direct supervision at all times.
- Apex Fitness Center does not provide childcare services.
- I assume full responsibility for any child accompanying me.
☐ I understand that violation of this policy may result in immediate termination of access.
7. EQUIPMENT USE
☐ I accept full responsibility for the proper use of equipment.
☐ I will inspect equipment prior to use and report any unsafe condition.
8. MEMBERSHIP POLICY
☐ I acknowledge and agree:
- All sales are final (no refunds)
- Monthly memberships cannot be frozen or paused
9. PHOTO & VIDEO RELEASE
☐ I grant permission for Apex Fitness Center to use my image, likeness, and participation for marketing and promotional purposes without compensation.
10. COMMUNICABLE DISEASE ACKNOWLEDGMENT
☐ I understand participation may expose me to communicable diseases (including COVID-19) and assume all related risks.
11. DIGITAL SIGNATURE CONSENT
☐ I understand that by signing electronically:
- This Agreement is legally binding
- My electronic signature has the same legal effect as a handwritten signature
- I have read and fully agree to all terms
